New York State passed legislation that raises the lower age of juvenile delinquency to 12 years old, with limited exceptions for homicide related offenses.  The new law, which goes into effect on 12/29/22,  requires each local department of social services to provide a Differential Response for children ages 7 through 11 who no longer fall under the definition of Juvenile Delinquent and will no longer be subject to arrest.    The purpose of the Differential Response is to offer voluntary support services to eligible youths with the goal of preventing future interaction with the juvenile justice system.  The focus of this training is to inform Orange County law enforcement officers how to activate a Differential Response when investigating an offense committed by a youth 7-11 years of age.
